	~~സാക്ഷ്യപ്രതം~~		Wherever auctions are held by LSGI there should be transparent procedures. The Panchayats and the Municipalities should disclose the various items which are given by auction, the likely time of auction and the amount received during the previous years, during Grama Sabha, Ward Sabha and Ward Committee meetings. There must be a Compulsory display by all LSGIs indicating the various items, which are auctioned, the name of the successful bidder and the amount. This should be permanently exhibited at the site like the sand mining place, market, slaughterhouse, shop building etc.

This should be advertised in brief in at least three newspapers having largest circulation in the district as a general advertisement and in the website of LSC with all details (www.lsg.kerala.gov.in). As far as ULBs are concerned this advertisement Could be given for a group of ULBs in every district. The joint Director of Municipalities could facilitate this.

	~~2 7.~~		വിഷയം:- തദ്ദേശസ്വയംഭരണ സ്ഥാപനങ്ങൾ - കേരള നദീതീര സംരക്ഷണവും മണൽ വാരൽ നിയന്ത്രണവും ആക്ടിലെയും അതിൻകീഴിൽ ഉണ്ടാക്കിയ ചട്ടങ്ങളിലെയും വ്യവസ്ഥകൾ കർശനമായി പാലിക്കുന്നതിനും ജലസ്രോതസ്സുകൾ മലിനപ്പെടുത്തുന്നത് തടയുന്നതിനും നിർദ്ദേശം പുറപ്പെടുവിക്കുന്നു. സൂചന:- 1) 2001-ലെ കേരള നദീതീര സംരക്ഷണവും മണൽവാരൽ നിയന്ത്രണവും ആക്സ്ടും ചട്ടങ്ങളും. 2) 01-02-2005-ലെ നമ്പർ 71734/പി1/2004/റവന്യൂ സർക്കുലർ, നദികളിൽ നിന്നും വിവേചനരഹിതവും അനിയന്ത്രിതവുമായ മണൽവാരൽ നദീതീരങ്ങളിൽ വൻ തോതിൽ മണ്ണിടിച്ചിലിനും വസ്തുക്കളുടെ നാശനഷ്ടത്തിനും നദിയുടെ ജൈവ ഭൗതിക പരിസ്ഥിതി വ്യവസ്ഥയെ വ്യത്യസ്ത അളവുകളിൽ തകരാറിലാക്കുന്നതിനും കാരണമാകുന്നതായി സർക്കാരിന്റെ ശ്രദ്ധ യിൽപ്പെട്ടതിനെ തുടർന്ന് 2001-ലെ കേരള നദീതീര സംരക്ഷണവും മണൽവാരൽ നിയന്ത്രണവും 2002 ലെ കേരള നദീതീര സംരക്ഷണവും മണൽവാരൽ നിയന്ത്രണവും ആക്സ്ടും ചട്ടങ്ങളും പ്രാബല്യത്തിൽ കൊണ്ടുവരികയുണ്ടായി. പ്രസ്തുത നിയമത്തിലെ വ്യവസ്ഥകൾ കർശനമായി പാലിക്കണമെന്ന് നിർദ്ദേശി ച്ചുകൊണ്ട് സൂചന (2) പ്രകാരം വിശദമായ നിർദ്ദേശങ്ങളും പുറപ്പെടുവിക്കുകയുണ്ടായി. പ്രസ്തുത സർക്കു ലറിൽ, ഓരോ മാസവും ഓരോ കടവിൽ നിന്നും വാരാവുന്ന മണലിന്റെ അളവ് ജില്ലാ വിദഗ്ദദ്ധ സമിതി സെന്റർ ഫോർ എർത്ത് സയൻസ് സ്റ്റഡീസ് സെന്റർ ഫോർ വാട്ടർ റിസോഴ്സ് ഡെവലപ്മെന്റ് ആന്റ് മാനേജ്മെന്റ് തുടങ്ങിയ വിദഗ്ദദ്ധ സമിതികളുടെ മാർഗ്ഗനിർദ്ദേശം കണക്കിലെടുത്ത് നിശ്ചയിക്കണമെന്നും മണൽ വിൽപ്പനയിൽ സ്വരൂപിക്കുന്ന തുകയിൽ നിന്ന് റോയൽറ്റി നൽകിയ തുക കുറച്ച ശേഷം ബാക്കി തുകയുടെ 50% ജില്ലാ കളക്ടർ വച്ചു പോരുന്ന റിവർ മാനേജ്മെന്റ് ഫണ്ടിലേക്കും ബാക്കി 50% അതത് തദ്ദേശ സ്വയംഭരണ സ്ഥാപനങ്ങൾക്ക് അതതു മാസം തന്നെ നൽകണമെന്നും നിഷ്കർഷിച്ചിരുന്നു. കൂടാതെ മണൽ വാരുന്നതും കൊണ്ടുപോകുന്നതും രാവിലെ 8 മണിക്ക് ശേഷവും വൈകുന്നേരം 4 മണിക്ക് മുമ്പും ആയിരിക്കണമെന്നും വൈകുന്നേരം 4 മണിമുതൽ രാവിലെ 8 മണി വരെ കടവുകൾ പുട്ടിയിടണമെന്നും കടവുകളിൽ ലോറി ഇറങ്ങാൻ കഴിയാത്തവിധം തൂണുകൾ സ്ഥാപിക്കുകയും മണൽ വാരൽ അനുവദി ക്കുന്ന എല്ലാ കടവുകളിലും വാഹനങ്ങൾ ഇറക്കാൻ കഴിയാത്തവിധം 100 മീറ്റർ അകലം മുതൽ പ്രൊട്ട ക്ഷൻ വാൾ നിർമ്മിക്കേണ്ടതാണെന്നും സ്വകാര്യ വസ്തുക്കളോട് ചേർന്നുള്ള എല്ലാ അനധികൃത കടവു കളും പുഴയോരത്ത് വച്ച് അടച്ചുകെട്ടി ക്ലോസ് ചെയ്യേണ്ടതാണെന്നും നിഷ്കർഷിച്ചിരുന്നു. അനധികൃത മായി മണൽ വാരാനും കയറ്റാനും ഉപയോഗിക്കുന്ന ഉപകരണങ്ങൾ, വള്ളങ്ങൾ, അത്തരം മണൽ കയറ്റി

	~~It has come to~~ the ~~notice~~ of the ~~Government that nails are driven into roadside trees while~~ the ~~hoardings~~ and ~~billboards are erected~~. ~~Many trees~~ are ~~under threat as this is rampant. This is causing injury~~, ~~decay~~ and ~~eventual death of said trees~~. ~~The Hon’ble High Court of Kerala has taken suo-moto case against~~ the ~~Government on~~ the ~~letter sent by the students of St. Augustine's Girls High School~~, ~~Muvattupuzha~~.
	~~Protection~~ of ~~trees is a top priority~~ of the ~~Government. The roadside trees lenda sylvan-beauty~~ to the ~~streets besides their environmental exercise~~. ~~Display of~~ advertisement in ~~streets and public places~~ in ~~Grama Panchayats and Municipalities~~ are ~~regulated by sections~~ of Kerala Panchayat Raj Act~~, 1994~~ and Kerala ~~Municipalities~~ (~~Erection of Arches and Advertisements Boards in Public Places~~) ~~Rules~~, ~~1999 respectively~~. Hence the Local Self Governments are directed to incorporate the condition, while according permission for the erection of hoardings and billboards for advertisement, that no damage, injury or harm shall be made/ ~~happened to the trees when trees are used for advertisement~~. ~~Those who contravene the Condition will be liable for penalty~~. ~~The Local Self Governments shall also to ensure that all hoardings and advertisement boards which are nailed into trees are removed immediately~~. ~~Top priority shall be given to comply with the foregoing directions~~, ~~in view of obvious urgency in~~ the ~~matter.~~

Sub:- Local Self Government Department - Setting up of hoardings on trees for advertisements - Institutions to Local Self Government Institutions-reg.
It has come to the notice of the Government that nails are driven into roadside trees while the hoardings and billboards are erected. Many trees are under threat as this is rampant. This is causing injury, decay and eventual death of said trees. The Hon’ble High Court of Kerala has taken suo-moto case against the Government on the letter sent by the students of St. Augustine's Girls High School, Muvattupuzha.
Protection of trees is a top priority of the Government. The roadside trees lenda sylvan-beauty to the streets besides their environmental exercise. Display of advertisement in streets and public places in Grama Panchayats and Municipalities are regulated by sections of Kerala Panchayat Raj Act, 1994 and Kerala Municipalities (Erection of Arches and Advertisements Boards in Public Places) Rules, 1999 respectively. Hence the Local Self Governments are directed to incorporate the condition, while according permission for the erection of hoardings and billboards for advertisement, that no damage, injury or harm shall be made/ happened to the trees when trees are used for advertisement. Those who contravene the Condition will be liable for penalty. The Local Self Governments shall also to ensure that all hoardings and advertisement boards which are nailed into trees are removed immediately. Top priority shall be given to comply with the foregoing directions, in view of obvious urgency in the matter.
